General terms and conditions of sale

Article 1: General terms and conditions 

1.1 Purpose

Maison Val Roubion SARL is a limited liability company with a capital of 8,000.00 euros, whose registered office is located at 3 bis Avenue d'Aygu, 26200 Montélimar. 

These general terms and conditions of sale govern all relations between Maison Val Roubion and the customers of its website www.maisonvalroubion.com (hereinafter referred to as the "website"), which enables orders to be placed for products to be delivered to the customer's home.

Full acceptance of the general terms and conditions of sale is necessary and indispensable in order to place an order. Consequently, the purchaser may not invoke the opposability of any clause whatsoever, as the placing of an order constitutes acceptance of these terms and conditions. 

They will therefore govern relations between Maison Val Roubion and any individual of legal age who is not a trader, in connection with the sale of products offered on the website, for delivery in France and in all countries of the European Union. 

The buyer will be referred to in this document as "you". 

1.2 Customer's legal capacity 

By placing an order on the website, you declare that you have full legal capacity to commit yourself in accordance with these general terms and conditions of sale. 

1.3 login and customer account 

When you place your first order, you must choose and provide an e-mail address, as well as a password if you wish to create an account. The system will then check that the username is unique. Your password, which is strictly confidential, will be requested for each transaction made with this account. If you lose or forget your password, you can use the "forgotten password" option and enter your e-mail address. A link will be sent to you by e-mail to reset your password once your e-mail address has been recognised.  

1.4 Modification of the General Terms and Conditions of Sale

In view of possible changes to the website, Maison Val Roubion reserves the right to adapt or modify these general terms and conditions of sale at any time. The new general terms and conditions of sale will, where applicable, be brought to the attention of the client for modification online and will only apply to sales made after the modification.  

Article 2: Products 

The list and characteristics of the products offered on the website may be modified and adapted at any time to better meet your expectations and/or depending on available stocks. 

Information relating to products can be accessed by clicking on the product name or photograph. This information is intended, without being exhaustive, to inform you as fully as possible about the essential characteristics of the products. The products offered on the website comply with French legislation and standards applicable in France. The products are available at the prices and under the conditions offered as long as they are present on the website (while stocks last). 

Article 3: Product prices 

The sale prices of the products marketed on the website are expressed in euros, inclusive of all taxes. They include the current French VAT. Any change in the French VAT rate will be immediately reflected in the prices. The general price list may be freely revised by Maison Val Roubion. 

Article 4: Placing an order

4.1 Registration of the order 

Online orders can only be placed via the website, which presents a selection of Maison Val Roubion products. Orders placed by post or telephone will not be taken into account.

All products ordered on the website are summarised in your basket before you are invited to confirm your order by indicating the address of the relay shop or the home delivery address. 

Payment of the price of the products makes the order definitive, subject to the application of article 4.3 below. 

4.2 Confirmation of order validation & order preparation 

When the website confirms the validation of your order, you will receive an e-mail indicating an order number. All the information that you provide when placing an order is binding on you and in particular that concerning the recipient of the order (name, address, etc.) and any anomalies generated as a result cannot be held against Maison Val Roubion in the event that it is unable to execute the order and bring it to a successful conclusion. As soon as the product is dispatched, you will receive an e-mail from the carrier giving you the tracking number for the parcel and a link enabling you to check the progress of the parcel in real time (GLS). 

4.3 Order cancellation conditions

Due to its specific nature, the foodstuffs sold on the site are likely to deteriorate or expire quickly. Consequently, in accordance with article L.221-28, 4° of the French Consumer Code, you do not have the right to cancel your order.

However, you may cancel your order under certain conditions; the period within which you may cancel the order is set at 24 hours after payment has been made, provided that the order has not already been dispatched. Once the order has been dispatched, you can no longer cancel it. Exceptionally, an item advertised as available on our site may be unavailable once the order has been definitively registered. In this case, you will receive a letter informing you of the delivery time. You may then, if you wish, cancel your order. 

Article 5: Payment of the order 

Online payment is made exclusively by credit card or PayPal. 

To do this, choose your type of card (Carte Bleue, VISA, Mastercard, American Express), enter your card number, its expiry date and your cryptogram code (made up of three digits located on the back of your bank card) then validate your data or click on "Cancel-Return to shop" to return to the previous page. 

In order to provide you with the most reliable and secure service, we have chosen the Monetico payment system. All data is encrypted to ensure that it is transmitted in complete security and confidentiality. No payment data is stored on our site. Your payment request is sent in real time to the Monetico secure payment system: the bank checks that your bank card is valid (no input errors, no opposition), confirms that your payment has been recorded by issuing a transaction number or informs you that the transaction has been refused. 

Your account will be debited for the amount of your order.

Article 7: Responsibilities

We do our best to describe and present our items as accurately as possible on our website. However, please note that colours may be altered by the settings on your computer screen, and we cannot contractually guarantee their accuracy. With regard to the operation and continuity of the online service, we undertake to do our best, but we cannot be held responsible for any inconvenience or damage resulting from the use of the Internet, such as service interruptions, the presence of computer viruses, external intrusions, or any other case of force majeure recognised by the French courts. Payment of the price of the products confirms your order definitively. Maison Val Roubion cannot be held responsible if the information relating to your order is incomplete, insufficient or erroneous, and if it prevents the carrier appointed by Maison Val Roubion from making the delivery or from leaving a delivery notice. 

Article 8: Prohibition on sales outside the network

Our products are intended exclusively for sale through our distribution channels. Consequently, the purchase of our products with the aim of reselling them outside our channels, including on Internet sites or markets, is strictly PROHIBITED. In addition to damaging our brand and the integrity of our products, such actions could lead to legal consequences, both civil and criminal, for those involved. 

Article 9: Force majeure

Maison Val Roubion is exempt from liability in all cases of force majeure, linked to irresistible, unforeseeable and external circumstances. Cases of force majeure include recognised disasters or bad weather, strikes by logistics service providers, or any other event likely to disrupt the smooth flow of merchandise and IT flows.  

Article 10: Sales to minors

In application of articles L.3342-1 and L.3353-3 of the French Public Health Code, which prohibit the sale of alcohol to minors, you undertake to be at least 18 years of age when validating your order, before payment, by accepting the present general conditions of sale. Maison Val Roubion reserves the right to ask you for a copy of a valid identity document to confirm that you have reached the age of majority. In the event that Maison Val Roubion makes this request of the client, failure to present a valid form of identification will result in the cancellation of the order by Maison Val Roubion. 

We remind you that alcohol abuse is dangerous to your health and should be consumed in moderation.

Article 11: Applicable law and disputes

These general terms and conditions of sale are governed by French law. In the event of a dispute, an amicable solution will be sought as a priority before any legal action is taken. In the absence of an amicable solution, any legal action will be brought before the competent courts.
